PoliPrep Terms of Service

These Terms of Service ("Terms") govern access to and use of the PoliPrep website, platform, educational content, courses, simulations, community features, and related services (collectively, the "Services").

By accessing or using the Services, you agree to these Terms. If you do not agree with these Terms, do not use the Services.

For consumers, these Terms do not limit or exclude any mandatory rights granted by applicable consumer-protection law.

For these Terms:

"PoliPrep", "we", "us" or "our" means Islam Fakrul, Ditta Individuale, operating the PoliPrep platform.

"User", "you" or "your" means any person accessing or using the Services.

"Consumer" means a natural person acting for purposes outside that person's trade, business, craft or profession, where applicable under Italian and EU law.

"Course" means an educational program offered by PoliPrep, which may include recorded lessons, live sessions, mock examinations, exercises, study materials, mentoring, and other educational resources.

"Simulation" means a digital examination or mock-test product offered separately from a Course.

"Cohort" means a group of students enrolled in the same Course intake and associated schedule.

"PoliPrep Content" means educational videos, lessons, exercises, mock tests, written materials, graphics, recordings, software, text, curriculum materials, and other content made available by PoliPrep.

"Community Features" means discussion spaces or communications made available by PoliPrep, including, where offered, Telegram, WhatsApp, or other third-party community services.

PoliPrep is intended for users aged 16 or older.

If you are under 18, you confirm that you have obtained any consent or authorization from your parent or legal guardian that is required under applicable law to use the Services or enter into a paid agreement.

You must provide accurate and up-to-date information when creating an account or purchasing a Service.

You are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account, except where unauthorized use results from circumstances outside your reasonable control.

PoliPrep provides educational and preparation services relating to university admission tests, university courses, language and standardized tests, and related academic preparation.

The Services may include, among other things: Admission test preparation, including TOLC-I, CEnT-S and ARCHED; University course preparation, including subjects such as Mathematical Analysis I and Computer Science; Recorded educational content; Live classes or sessions; Mock examinations and simulations; Exercises and study materials; Mentoring or educational support; Community and student discussion spaces.

The specific Services included in any purchase are those described on the relevant product or checkout page at the time of purchase.

Some services or features may be introduced, modified, or discontinued over time. Where a change materially affects an existing paid Service, PoliPrep will respect any mandatory rights and remedies available to the consumer under applicable law.

Certain Services may require an account.

You agree to: provide truthful and accurate registration information; keep your login credentials secure; not share your account with another person; promptly notify PoliPrep of suspected unauthorized access.

Your account is personal to you and may not be sold, transferred, rented, or shared.

Unless otherwise required by law, PoliPrep may restrict or suspend an account where there is reasonable evidence of fraud, unauthorized access, abuse, or a serious violation of these Terms.

Where a Course is sold on a cohort basis, enrollment gives the student access to the Course and the applicable materials and services for the cohort described on the product page.

Unless otherwise stated at purchase, cohort Courses are limited to a maximum of 20 students per cohort.

A Course may include recorded micro-lessons, live weekly sessions, mock examinations, exercises, study resources, and other educational activities.

The exact structure, schedule, duration, number of sessions, and included materials will be stated on the relevant Course page or at checkout.

PoliPrep may reasonably modify a Course schedule, instructor assignment, session timing, or delivery method where necessary for operational, technical, educational, or other legitimate reasons.

Where a change materially affects an existing paid Course, PoliPrep will provide reasonable notice and, where required by applicable law, appropriate remedies.

Access credentials are personal and may not be shared with other students.

Students must not record, redistribute, publish, sell, sublicense, or otherwise make Course Content available to third parties unless PoliPrep has given prior written permission.

PoliPrep may offer standalone simulation packages in different tiers.

The applicable price, number of simulations, features, and access period will be stated on the relevant product page before purchase.

Unless expressly stated otherwise, simulation purchases are one-time purchases and do not automatically renew.

A simulation is intended for individual educational use. Sharing access, attempting to bypass access controls, systematically copying questions, scraping the platform, or redistributing simulation content is prohibited.

All prices applicable to a purchase will be displayed before the consumer places the order.

PoliPrep operates under the Italian flat-rate tax regime (regime forfettario). Displayed prices are final prices: VAT is not applied pursuant to Article 1, paragraphs 54–89, of Law No. 190/2014.

The total price and any applicable charges will be communicated before the consumer becomes bound by the contract, in accordance with applicable law.

PoliPrep may offer promotional prices, introductory prices, founding-member prices, discount codes, or limited-time offers. Unless otherwise stated, promotions cannot be combined.

Where a discount code is used, the applicable conditions will be displayed at the time of use.

Payment must be completed through the payment methods presented at checkout.

An order that creates an obligation to pay will be presented with an appropriately clear payment-obligation indication as required by applicable law.

PoliPrep will provide the consumer with confirmation of the contract and relevant contractual information on a durable medium where required.

Where a consumer has a statutory right of withdrawal under applicable law, that right applies subject to the conditions and exceptions established by law.

For distance contracts, the general statutory withdrawal period is 14 days, subject to applicable exceptions and special rules.

The precise effect of withdrawal may depend on whether the purchased Service consists of a digital service, digital content, or a service that has already begun to be performed.

Where a purchase involves digital content supplied immediately after purchase, PoliPrep may request the consumer's express consent to begin performance before the expiry of the withdrawal period and the consumer's acknowledgement of the applicable legal consequences.

Any loss or limitation of the statutory withdrawal right will occur only where the conditions required by applicable law have been satisfied.

Access to a Service does not, by itself, eliminate rights that cannot lawfully be excluded.

Where a Service begins during the statutory withdrawal period at the consumer's express request, the consumer may have statutory rights concerning the proportionate payment for services already supplied, where applicable.

Additional refund rules applicable to PoliPrep Courses, Simulations, and other products are described in the PoliPrep Refund Policy, which forms part of the contractual information provided to the customer.

Nothing in the Refund Policy excludes or limits mandatory statutory rights.

If PoliPrep cancels a Cohort before the Course begins, enrolled students will receive a full refund of the amount paid for that Course, as described in the Refund Policy.

If PoliPrep cancels a Course after it has begun, PoliPrep will refund the amounts due under applicable law.

Where appropriate, PoliPrep may also offer a replacement cohort or alternative remedy, but the consumer's mandatory statutory rights remain unaffected.

Unless applicable law requires otherwise, refunds will generally be made using the same payment method used for the original transaction.

All PoliPrep Content, including educational materials, videos, mock tests, question banks, graphics, layouts, written materials, trademarks, logos, software, and other materials, is owned by or licensed to PoliPrep and is protected by applicable intellectual-property laws.

Subject to these Terms and your payment where applicable, PoliPrep grants you a limited, personal, non-exclusive, non-transferable and non-sublicensable right to access and use the relevant PoliPrep Content solely for your individual educational purposes during the applicable access period.

You may not, without prior written permission: reproduce or redistribute PoliPrep Content; resell or sublicense access; publicly publish Course materials; share account credentials; commercially exploit Course materials; systematically scrape or extract content; bypass technical access controls; reproduce or distribute simulation questions or answer databases; use PoliPrep Content to create a competing educational product; use PoliPrep Content to train, fine-tune, evaluate, or develop an artificial-intelligence or machine-learning model, except to the extent a mandatory legal exception expressly permits such use.

Nothing in these Terms limits rights that cannot lawfully be restricted under applicable copyright or other mandatory law.

Where PoliPrep allows users to submit comments, questions, feedback, images, text, recordings, or other materials ("User Content"), you retain ownership of your User Content.

By submitting User Content, you grant PoliPrep a non-exclusive, worldwide, royalty-free license to host, reproduce, process, display, and use that User Content as reasonably necessary to operate, provide, moderate, improve, and secure the Services.

PoliPrep will process personal data contained in User Content in accordance with the Privacy Policy.

You must not submit content that: violates another person's rights; contains unlawful or harmful material; impersonates another person; contains malicious code; reveals another person's confidential or personal information without appropriate authorization; infringes copyright, trademark, privacy, or other rights.

Community participation may also be subject to the PoliPrep Community Guidelines.

PoliPrep may provide access to community spaces hosted by third parties, including Telegram, WhatsApp, or other platforms.

Use of those services may be subject to the relevant third party's own terms, privacy policies, and technical requirements.

PoliPrep may moderate or remove content from PoliPrep-managed community spaces where reasonably necessary to enforce these Terms, the Community Guidelines, safety requirements, or applicable law.

PoliPrep is not responsible for the independent operation, availability, policies, or security of third-party communication platforms.

You agree not to use the Services to: violate applicable law; interfere with the operation or security of the platform; gain unauthorized access to systems, accounts, or data; upload malware or malicious code; scrape, crawl, or systematically extract data without permission; circumvent access restrictions or payment controls; share paid access with unauthorized users; harass, threaten, discriminate against, or abuse other users; impersonate PoliPrep or another person; exploit the Services for fraudulent or unlawful purposes.

You must not attempt to reverse engineer, decompile, or otherwise derive source code from the Services except where and to the extent such restriction is prohibited by applicable law.

The Services may include links to or integrations with third-party services.

Third-party services may have their own terms and privacy policies, and your use of them may be governed by those separate terms.

PoliPrep is not responsible for third-party services that it does not control, except where applicable law provides otherwise.

PoliPrep aims to provide reliable access to its Services but does not guarantee that the platform will always be uninterrupted, error-free, or available at every moment.

Temporary interruptions may occur because of maintenance, security incidents, infrastructure failures, updates, internet connectivity problems, or circumstances outside PoliPrep's reasonable control.

You are responsible for maintaining a compatible device, supported browser, stable internet connection, and any other technical requirements reasonably necessary to access the Services.

Where applicable law provides specific remedies for failure to supply or lack of conformity of digital content or digital services, those rights remain unaffected.

For consumers, PoliPrep's digital content and digital services are subject to the mandatory conformity requirements and remedies provided by applicable consumer law.

Where applicable, consumers may have legal rights including requesting that a digital service or digital content be brought into conformity, obtaining a proportionate reduction in price, or terminating the contract under the conditions established by law.

PoliPrep does not exclude or limit those mandatory rights through these Terms.

Nothing in these Terms affects the consumer's statutory rights concerning lack of conformity, failure to supply, or other mandatory legal remedies.

PoliPrep provides educational and preparation services.

We do not guarantee: admission to a particular university; a particular examination score; a particular academic grade; successful completion of an examination; acceptance by a university; any particular academic or professional outcome.

Official examination rules, dates, eligibility requirements, scoring systems, admissions decisions, and other requirements are determined by the relevant university, examination provider, governmental authority, or other official institution.

Information on PoliPrep may be provided for educational purposes and should not be treated as replacing official examination or university documentation.

You may stop using the Services at any time.

PoliPrep may suspend or terminate access where reasonably necessary because of: serious or repeated violations of these Terms; fraud or attempted fraud; unauthorized account sharing; unlawful activity; material security risks; abuse of other users or PoliPrep personnel.

Where appropriate and legally permitted, PoliPrep will provide notice and an opportunity to remedy a violation before suspension or termination.

Termination or suspension does not remove any rights or obligations that by their nature should continue after termination.

For consumers, any mandatory refund, withdrawal, conformity, or other statutory rights remain unaffected.

Personal data is processed in accordance with the PoliPrep Privacy Policy.

The Privacy Policy explains what personal data PoliPrep processes, why it is processed, applicable legal bases, retention periods, recipients, rights, and other information required under applicable data-protection law.

Use of non-essential cookies and similar technologies is governed by the PoliPrep Cookie Policy and the cookie-consent mechanism provided on the website.

To the maximum extent permitted by applicable law, PoliPrep is not responsible for indirect or unforeseeable losses arising from use of the Services.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability that cannot legally be excluded or limited.

In particular, nothing in these Terms excludes or limits: liability for death or personal injury where such liability cannot legally be excluded; liability for fraud or fraudulent misrepresentation; liability arising from intentional misconduct or gross negligence where exclusion is legally prohibited; statutory consumer rights and remedies; liability that cannot otherwise be excluded or limited under mandatory law.

PoliPrep's Services are educational services, and users remain responsible for their own study decisions, use of official information, and examination registration.

PoliPrep may update these Terms from time to time to reflect changes to the Services, applicable law, security requirements, or business operations.

The updated version will be published on the PoliPrep website with a revised "Last updated" date.

Where a change materially affects an existing paid contract and applicable law requires notice or consent, PoliPrep will follow the applicable legal requirements.

Changes to these Terms will not retroactively remove mandatory rights or alter a consumer's already-acquired statutory protections.

These Terms are governed by Italian law, without prejudice to mandatory consumer-protection provisions that apply to consumers under the law of their country of habitual residence or other applicable mandatory law.

Nothing in this clause prevents a consumer from exercising rights or bringing proceedings in a forum available under mandatory applicable law.

For users acting as businesses or professionals, to the extent legally permitted, the courts of Turin, Italy shall have jurisdiction over disputes arising from these Terms.

We will seek to handle complaints directly and in good faith.

Consumers may also have access to alternative dispute-resolution procedures through competent bodies under applicable Italian or European law.

Nothing in this section prevents a consumer from exercising mandatory legal rights or bringing proceedings before a competent court.

PoliPrep does not state that it is subject to a particular ADR body unless expressly indicated elsewhere on the website.

The former European Online Dispute Resolution (ODR) platform is not referenced here because that platform has been discontinued.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

Any invalid provision will be interpreted or replaced, where legally possible, so as to preserve its intended legal and commercial purpose without reducing any mandatory consumer protection.

A failure by PoliPrep to enforce a provision of these Terms does not constitute a waiver of that provision or of PoliPrep's right to enforce it later.

These Terms, together with the applicable product information, Refund Policy, Privacy Policy, Cookie Policy, and, where applicable, Community Guidelines, constitute the contractual framework governing your use of the Services.

Where a specific product page or order confirmation contains product-specific terms that are expressly stated to apply, those terms will also form part of the agreement.

If a conflict exists between these Terms and a mandatory legal provision, the mandatory legal provision prevails.

If a conflict exists between these Terms and a specific product term, the specific product term applies to that product to the extent it is lawful and does not remove mandatory consumer rights.

For users acting as businesses or professionals, pursuant to Articles 1341 and 1342 of the Italian Civil Code, the user specifically approves the following clauses: 4 (account restriction and suspension), 5.3 (schedule changes), 11 (third-party platforms), 14 (service availability), 17 (suspension and termination), 19 (liability), 20 (changes to the Services and these Terms) and 21 (governing law and jurisdiction of the courts of Turin).

This section does not apply to consumers, whose rights are governed by the Italian Consumer Code (Codice del Consumo) and other mandatory consumer-protection law.

By using PoliPrep or purchasing a Service, you acknowledge that you have had the opportunity to read these Terms and the other applicable legal documents before using the relevant Service or placing an order.
